Islamabad, May 19, 2016 (PPI-OT):The meeting of Senate standing committee on states and frontier region was held here at parliament house under the chairmanship of senator Hilal-ur-Rehman. On the question raised by senator Usman Kakar on the transfer of political agents in four agencies of FATA the Senator pointed out that the transfer of political agents by the chief secretary is unconstitutional and illegal.
He told the committee that when the transfer of political agents took place ex-governer KPK Sardar Mehtab Abbasi had already resigned. He further added that only governor KPK has the authority to post or transfer any political agent. He emphasized on reversing the orders immediately. Special invitee of the meeting senator Farhatullah Babar while giving the legal perspective said that Constitution of Pakistan doesn’t allow anyone except governor to post or transfer any political agent.
Senator Aitzaz Ahsan endorsed the opinion of senator Farhat-Ullah-Babar. He added that the decision of chief secretary can only be justified in accordance with the constitution if the new governor KPK endorses this. Chief Secretary KPK told the committee that he issued the transfer orders after the adoption of complete legal procedure and with the approval of chief minister KPK and ex-Governor KPK.
He told the committee that circumstances at that time were extraordinary and the issuance of posting orders was the necessity of the time. Chairman of the committee after analyzing all the point of views decided to request the house to extend the time for the presentation of report.
